The Court of Public Opinion U.S.A.

Expresses its own opinions in writing whether a public person or a government committed a wrong in social and political matters- humanitarian cause, the protection of the human rights, the democracy, the environment, and the defense of the US Constitution and what the punishment should be. This Court should also provide a peaceful way to decide private international disputes that people cannot resolve themselves.

Humphrey Humberto Pachecker- JD- LLM- Chief Magistrate of The Court of Public Opinion U.S.A. INGO, who is a member of the International Bar Association and the American Bar Association, was appointed to act for the Chief Justice in the affairs of the justice of the Court of Public Opinion U.S.A.

1. This Court of Public Opinion adheres to and observes the rules and status of the International Court of Justice- and

2. The United States Commission on Civil Rights.

COMPETENCE OF THE COURT.

[Article 33].

  1. States, any party and any person  may be parties in cases before this Court of Public Opinion [self-regulation].

  2. The Court, subject to and in conformity with its Rules, may request of public international organizations information relevant to cases before it, and shall receive such information presented by such organizations on their own initiative.

  3. Whenever the construction of the constituent instrument of a private party, a public international organization or of an international convention adopted thereunder is in question in a case before the Court, the Registrar shall so notify the public international organization concerned and shall communicate to it copies of all the written proceedings.

Trying cases in the Court of Public opinion also refers to using the media to influence public support for one side or the other in this court case. This can result in persons outside the justice system internationally, people other than the judge or public jury taking action for or against a party.

For instance, the reputation of a party may be greatly damaged even if they win the case. Lawyer Robert S. Bennett noted that when he represents high-profile clients, he sometimes finds them in a (figurative) Bermuda triangle of cross-currents generated by a criminal investigation, the news media, and the U.S. Congress. It has been noted that there is no Fifth Amendment right against self-incrimination in the Court of Public Opinion.

It is said that high-profile cases have important implications for balancing the right of the public to scrutinize the judicial process, the government and the right of the participants to a fair public trial.

An argument against U.S. ratification of the Statute of the International Criminal Court was that a politically motivated prosecutor might attempt to convict the United States in the court of public opinion of a violation of international law, by charging one of its military or civilian officials with war crimes.

The  Court of Public Opinion has been described as the most important informal court of instances and precedents, for example- these three international precedents:

(1)-. In the case of NAFA GROUP, Humphrey H. Pachecker v. Nicolas Maduro- Venezuela and Miguel Diaz Canel- Cuba , the Office of the High Commissioner for Human Rights- United Nations Office at Geneva argued that “after careful consideration of the contents of this petition, in which the petitioner bring a complaint against Venezuela and Cuba for various alleged human rights violations, we [the United Nations Office at Geneva] sincerely regret having to inform you that the United Nations Office of the High Commissioner for Human Rights is not in a position to assist you in the matter you raise. Kindly note that the Committee against Torture cannot examine individual communications alleging violations of the Convention against Torture unless the State is also a party to the Optional Protocol to the Convention. Cuba is not a State party to the Optional Protocol, which means that individuals may not bring complaints under the Convention against Torture against Cuba at this time.  As to your complaint against Venezuela, kindly note that the Committee against Torture may not examine individual communications unless all available and effective domestic remedies have been exhausted first…”

(2)-. It could be argued that the prosecutor in the Duke lacrosse case attempted to try the case in the court of public opinion by making unsupported allegations to the media.

(3)-. In the Kobe Bryant sexual assault case, it was alleged that parties were using court pleadings as press releases.

International Precedent refers to a court decision that is considered as authority for deciding subsequent cases involving identical or similar facts, or similar legal issues. Precedent is incorporated into the doctrine of stare decisis and requires courts to apply the law in the same manner to cases with the same facts.

Registered and Controlled by AICAC-HR COURT- Washington D.C., a civil society organizations established on community, national, and international levels to serve a social and political goals such as a humanitarian cause, the protection of the human rights, the democracy, the environment, and the defense of the US Constitution that establishes a federal democratic republic form of government. We have an indivisible union of 50 sovereign States. It is a democracy people govern themselves. It is representative because people choose elected officials by free and secret ballot. The Republic of the United States of America.

The Court of Public Opinion U.S.A. System currently employs 6 personnel, has 3 Courts offices which process petitions in 1 location in the State of Florida. The court has jurisdiction over civil matters and human rights matters cases in which social and political goals such as a humanitarian cause, the protection of the human rights, the democracy, the environment, and the defense of the US Constitution is authorized to hear and may act as committing magistrates for all cases within this civil competence of INGO.

Any institution and any natural person can report alleged violations of human rights, civil rights, political rights, labor rights and file a complaint directly before this Court of Public Opinion USA, or through a representative. People who consider that they have been victims of violations of their human rights, civil rights, political rights, and labor rights may file a petition before this Court to initiate a process in which the facts are verified and, when appropriate, recommendations are made to the pertinent authorities and or to the responsible State regarding the violated rights, in such a way that similar events do not occur again in the future and the events occurred are investigated and repaired.

All observers and defenders certified by the Human Rights Commission of the AICAC-HR Court have the power- in free jurisdiction, that is predicated on this Court jurisdictional body to resolve without limitation all possible issues that may arise from a matter that will be heard.
